Terms of Service

1. Definitions

In these Terms, the following definitions apply. "Company" means HOSHEN Media Group and/or Musictons, operators of the Musictons platform. "Client" means any individual or entity that purchases a package, subscription, or service from the Company. "Package" means any of the service packages published on the Company's pricing page. "Mini-site" means the dedicated press-kit page produced by the Company for the Client as part of a package. "Professional Targets" means the performance targets stated in each package, including views, publications, coverage and interviews.

2. Services

The Company offers professional PR packages for the release of songs, music videos, and albums, including distribution to Jewish radio stations worldwide, outreach to journalists and media professionals, promotion of videos across digital platforms, and production of dedicated mini-sites for each release. The exact scope of each package is published on the pricing page and forms an integral part of these Terms.

All professional actions included in a package are performed by the Company's team at a high standard, with full commitment to quality and expertise.

3. Results and Performance Targets

The professional targets stated in each package, including view counts, press publications, radio or TV interviews, and coverage on digital outlets, reflect the quality and expertise of the Company, and represent professional aspirational targets.

Actual campaign outcomes are influenced by a range of professional factors beyond the Company's control. Among them, the production quality of the song or video, audience taste, digital platform algorithms, the editorial judgment of journalists, editors, broadcasters and other media stakeholders, and the availability of third parties.

Accordingly, nothing on the Company's pages, in official proposals, or in marketing materials shall constitute a commitment to a specific numerical outcome. The Company commits to the professional and complete execution of all actions detailed in the purchased package.

4. Payment

Payment for each package is due in full and in advance, before work begins. The Company will commence work on the project only after full payment has been actually received.

Package prices shown on the pricing page are starting prices ("from"). The final price is set in a personalized proposal for each Client, based on scope, degree of geographic targeting to Jewish communities, intensity of the YouTube campaign, song length (recommended up to 4 minutes), and any additional services selected.

Payment does not include applicable taxes payable by the Client under law. A tax invoice is issued upon payment.

5. Cancellation and Refunds

Given the professional nature of the services and the Company's commitments to third parties upon receipt of payment, no refunds are available once execution has begun.

Orders may be cancelled in writing prior to the commencement of work. A cancellation before work begins entitles the Client to a refund of the amount paid, less a handling fee equal to 15% of the amount. Once work has actually begun, no refunds are available.

6. Song Length

We recommend that artists keep song length under 4 minutes, as longer songs make effective digital promotion on major platforms more difficult.

For songs longer than 4 minutes, the price may vary significantly due to higher promotion costs. A price adjustment will be reflected in the personalized proposal to the Client.

7. The Mini-Site

As part of every package, the Company produces a dedicated mini-site for the release, containing the press release, gallery, links, and relevant content. The mini-site is operated on the Company's servers.

After the end of the package service period, the mini-site will remain live on the Company's servers for a complimentary trial period of 3 months. After this period, a continued-access subscription is required to keep the mini-site active.

8. Continued Access Subscription ($10 / month)

After the 3-month trial ends, the Client may join a continued-access subscription at $10 per month per account. A single subscription covers all mini-sites registered under the same Client account, with no limit on the number of sites.

The subscription includes: keeping all mini-sites live on the Company's servers, full analytics dashboard access across all releases, per-journalist warmth scoring, real-time view/click/download counters, and access to the AI copywriter and journalist matcher tools.

Billing is monthly, via a recurring charge on the registered payment method. The subscription may be cancelled at any time through the dashboard or by contacting the Company.

9. End of Subscription and Data Deletion

If the subscription is not renewed or is cancelled, the mini-sites under the account will move to "archive" status and will not be publicly accessible.

The Company will retain the data and content on its servers for a limited period of 60 days from the end of the subscription, to allow restoration in case of renewal. After this period, the Company reserves the right to permanently delete the mini-sites and any related data.

The Company will send an email notice 14 days and 3 days before final deletion, to the registered email address of the Client.

10. Client-Provided Content

The Client represents that they are the sole owner or full rights holder of all content provided to the Company, including songs, videos, images, lyrics, credits and press releases.

The Client grants the Company an irrevocable license to distribute the content in the course of providing the service, including sending to journalists, radio stations, digital platforms, and displaying on the mini-site.

The Client agrees to indemnify the Company for any third-party claim regarding copyright, performers' rights, production rights, or any other right in the content provided by the Client.

11. Confidentiality and Privacy

The Company undertakes to maintain full confidentiality of all personal and professional information provided by the Client, and to use it solely for the purpose of providing the service.

The Company uses accepted information-security measures to protect Client and user data. Data collection and processing are performed in accordance with the Company's privacy policy.

12. Limitation of Liability

The Company, its representatives, employees, partners and suppliers shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data, goodwill or business opportunities, arising from use or inability to use the Company's services, even if the Company was advised of the possibility of such damages.

In any event, the Company's total liability, if any, shall not exceed the amount actually paid by the Client for the relevant package or service during the three months preceding the damage event.

13. Changes to the Terms

The Company reserves the right to update and change these Terms from time to time. Material changes will be brought to the Client's attention through updates on this page and/or notice to the registered email.

Continued use of the Company's services after an update constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms and the relationship between the Client and the Company shall be governed solely by the laws of the State of Israel. Exclusive jurisdiction in any dispute or disagreement arising from or related to these Terms shall be vested in the competent courts of the Tel Aviv-Jaffa district.
